To provide you with quality service you will be assigned your own sales manager. By signing this page regardless of whether service is actually provided, the Client (“Client”), his, her or its agents, heirs, assigns and guests agree to accept these terms and conditions and to be bound by the same.
Custom Coach & Limo Payment Policy
Custom Coach & Limo requires a valid credit/debit card to hold and secure your reservation (unless other arrangements are made, in writing, by Client and Custom Coach & Limo) Your credit card will be charged for all deposits and balances (deposit 20% due upon receipt of confirmation - full balance due 7 days prior to departure date unless other arrangements are made, in writing, by Client and Custom Coach & Limo). Custom Coach & Limo also accepts certified checks, business checks, personal checks and money orders. Custom Coach & Limo is not responsible for any overdrawn bank fees by virtue of you providing your credit card or debit card number. If payment is made by check, Client agrees to reimburse Custom Coach & Limo for any bank fees occurred for insufficient funds or similar/related banking issues/problems. All Clients paying by check hereby authorize Custom Coach & Limo to authorize/charge Client’s credit card if the balance check is not received by the payment due date. Client agrees that if Custom Coach & Limo does not receive payment by the payment due date Client’s credit/debit card will be charged for the full charter cost minus any down payment.
First Come First Serve
Charters are reserved on a first come, first served basis. Custom Coach & Limo reserves the right to cancel this reservation if Client’s requested vehicle is unavailable at the time of booking, has mechanical fault, or if Client is late on their payments. If Client’s requested vehicle is unavailable Client may approve Custom Coach & Limo to continue to seek other alternative vehicles to accommodate Client’s travel needs. Authorizing Custom Coach & Limo to seek another vehicle may increase or decrease Client’s charter cost rate depending on a number of factors including, but not limited to availability of alternate transportation or Client’s decision to “upgrade” or “downgrade” the type of transportation utilized. Client may decide at that point if they would like to proceed with the new vehicle and new charter rate.
Sign And Return Your Final Confirmation
Once this reservation form is processed, Custom Coach & Limo will send a final charter confirmation to the Client (process can take up to 72 hours) that will include charter number. Client agrees that if Custom Coach & Limo does not receive the signed final confirmation with in 48 hours of receipt Custom Coach & Limo is not responsible for errors such as: wrong pick up times, locations, and vehicles. No date is guaranteed until this office receives the signed final confirmation.
If the national average for diesel or petrol fuel rises above $4.00 per gallon higher then the date of booking an additional 5% surcharge may be added to the charter price. Before any price is changed for any Client, Custom Coach & Limo will contact the Client and make the Client aware of any additional fees. At the time of contact Client has the right to cancel all services and be eligible for a full refund minus an administrative fee of $50.00
Custom Coach & Limo must receive all cancellations in writing only. Client agrees that Custom Coach & Limo must receive their cancellation in writing via fax (732-862-1219). Cancellations are only valid if made by the person whose name appears on the contract. An additional $145.00 administrative fee will be assessed on any cancellations on charters of less than $5000.00, a $250.00 administrative fee will be assessed on any cancellations on charters of more than $5000.00, regardless of the time of cancellation. Cancellation thirty (30) to fourteen (14) calendar days prior to date of charter will result in a loss of the deposit. Cancellation thirteen (13) to eight (8) calendar days prior to date of charter will result in an amount due equal to 30% of total charter cost. Cancellation seven (7) calendar days or less prior to date of charter will result in an amount due equal to 100% of total charter cost. The Cancellation Policy applies to any Client who reserves a vehicle less than 30 days of departure. All charters are subject to cancellation if payments are not made by due date. If an event is cancelled due to inclement weather, defined only as venue closure, Custom Coach & Limo, has the right to charge the client up to a $500.00 cancellation fee. If the client cancels because of inclement weather but venue is open, Custom Coach & Limo reserve the right to charge 100% of charter cost. Management will review all refund requests. Any request for refunds must be made in writing and made no later than 30 days after the scheduled charter. Refunds will be given at the sole discretion of Custom Coach and Limo, pursuant to the terms of this agreement.
Overtime time is available at the drivers’ and Custom Coach & Limos’ discretion. Overtime rates as follows: 24 to 56 passenger charter - $95 per half hour; Limos, Buses & Exotic Limos - $175.00 per half hour; Specialty vehicles such as Maybach, & Rolls Royce Phantom - $350.00 per half hour. Total cost is based on services detailed in your final confirmation and is subject to change in accordance with the actual itinerary. Please keep in mind overtime is not always available. If Custom Coach & Limo declines a Clients overtime request then the chartered vehicle will depart no later then twenty (20) minutes after the departure time listed on this reservation form regardless of whether all clients and/or guests are present and on board.
Contract changes must be received in writing and must be approved by Custom Coach & Limo in writing. All changes must be submitted to Custom Coach & Limo at least three (3) business days prior to Charter departure date. No change or modification of this confirmation shall be valid unless approved by Custom Coach & Limo. Changes may increase the total charter rate.
This company reserves the right to lease equipment from other companies to fulfill this agreement. Client is responsible to make and pay for any reservations for ferry service used to transport vehicles. Client is responsible to make any and all reservations that may be needed for buses in order for services to be provide, including but not limited to parking permits, parking space availability, and special access permission. In the event that Custom Coach & Limo, for reasons of beyond it’s control, is unable to perform under this contract, and unable to provide replacement transportation, which Custom Coach & Limo shall select in it’s own discretion, the liability of Custom Coach & Limo shall be limited to a refund of any monies paid by the Client hereunder, without regards to incidental, consequential or special damages, whether foreseeable or not.
Party bus seating capacity is measured thigh to thigh at an estimated 18-20 inches per seat. If a passenger is bigger or takes up more space then that then Custom Coach & Limo cannot guarantee actual seating capacity. Custom Coach & Limo has the right to upgrade a vehicle at its own discretion without notice. If there is a problem with a charter in progress, client must contact Custom Coach & Limo dispatch department at 866-952-8737, and make Custom Coach & Limo aware of the situation. If client does not contact the 24/hr Dispatch department while problem is occurring, Custom Coach & Limo will not be held liable for any issues. This company shall not be liable for items left on the vehicle or loss of time to due to mechanical failure, inclement weather, or road conditions (road repair, accidents) or other acts, including Acts of God over which Custom Coach & Limo has no control.
In the event that the vehicle supplied by Custom Coach & Limo sustains mechanical, electrical, or other problems to render it inoperable, Custom Coach & Limo shall, at its sole option and discretion, provide another vehicle (color may vary). Regardless of the quality and cost to complete the Charter obligation any such replacement vehicle will satisfy Custom Coach & Limo’s responsibility under this agreement. There will be no refund if an alternate vehicle(s) is supplied.
In the event that one or more electrical systems (such as, but not limited to: Air Conditioning, Heat, Restroom, Radio, Television or Problems with Automated Directions) shall malfunction, Custom Coach & Limo shall refund no more than five percent (5%) of the Charter cost, at its sole discretion, regardless of the number of mechanical or electrical problems encountered. Should Custom Coach & Limo be responsible for “response time” or “time delay” due to its own fault, (defined only by a dispatch error on Custom Coach & Limos’ behalf, not dispatch delay caused by the Client) Custom Coach & Limo shall refund no more than five percent (5%) of the Charter cost, at its sole discretion, for a specific vehicle for each 30 minute period in which that vehicle is late after the first 30 minutes, after pick up time, up to twenty percent (20%) of the total Charter cost (only applies to Day Trips, not Overnight Trips).
Custom Coach & Limo’s liability hereunder is limited to the amount stipulated in the confirmation and is not liable to Client for any and all consequential damages, including, but not limited to the costs of hiring substitute and/or additional transportation, spoiled catering, food and/or beverages, concert, theater, sports and/or other event tickets, admissions cost, reservations, plane or train tickets, and/or any and all other losses related to late pickup or no-show of requested transportation.
Any and all credits issued by Custom Coach & Limo expire within 2 year of credit date. Custom Coach & Limo cannot guarantee the assignment of any requested drivers, vehicles or amenities. During any trip over 14 hours the driver must have 8 hours off duty. Custom Coach & Limo shall not be liable for any incidental, consequential, or special damages, whether foreseeable or not, as a result of such delay. Any reasonable and unavoidable special fees or charges incurred will be in addition to all Charter rates as published.
Security agreements are as follows: Any damages to the vehicle caused by the client or his/her guests will be charged at actual full cost (including down time) to the client. Any excessive interior cleanup required (i.e. spills, vomiting, etc.) will be charged to the client at a minimum of two hundred fifty dollars ($250.00) per occurrence. The Client, guests, and all passengers are legally and financially responsible for any and all interior and exterior damages caused to the vehicle during the trip by the passengers. The undersigned also agrees that any charges that may arise may be charged to the credit card used for the reservation.
Alcohol / Behavior Policy
Under no circumstances do we allow alcohol on any of our vehicles. It is the Client’s responsibility to notify Custom Coach & Limo in advance if there will be food and/or & non-alcoholic beverages brought on board the coach. All requests must be made in writing at least three (3) days prior to the charter date and approved by Custom Coach & Limo. No smoking, drugs, sexual activity, or illegal substances are allowed in the vehicle. Custom Coach & Limo reserves the right to refuse such service to any person who, in the exclusive judgment of Custom Coach & Limo employees, is incapable of taking care of him or herself or whose conduct violates these policies, is objectionable, or presents a hazard to other persons, chauffeur, or vehicle. Upon such determination, Custom Coach & Limo shall be deemed to have completed its obligations to client under the Charter, and may terminate its service to client under Charter by dropping client off at the client’s home, nearest police station, or any other point mutually agreed to by Custom Coach & Limo and the Client. No glass containers are allowed on the buses at any time. If, during or after the transportation service, Custom Coach & Limo is required to expend a greater than normal amount of time and material to clean the equipment properly due to the acts of the passengers, Custom Coach & Limo will charge the Client’s credit card for actual additional costs to cover such time and materials. The cleaning of vomit, as noted above, will incur a service charge of no less than $250.00 per occurrence. The cost of repairing damage to vehicle from acts of the Client and/or guests to interior and exterior shall be charged to Client and is payable as soon as such cost is determined.

Post Charter Concerns
Please contact Client services regarding Client refunds. Client services may be reached at 866-952-8737. However, any request for a refund must be submitted in writing. Please use the charter number as the reference number. In the event of any dispute, claim, question, or disagreement arising from or relating to this agreement or the breach thereof the parties hereto shall use their best efforts to settle the dispute, claim, question or disagreement. To this effect, they shall consult and negotiate with each other in good faith and recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. No waiver of any provision of this contract shall be valid unless in writing and signed by the person against whom it is sought to be enforced. The failure of any party at any time to insist upon strict performance of any condition, promise, agreement or understanding set forth in this Contract shall not be construed as a waiver or relinquishment of the right to insist upon strict performance at future time.
Custom Coach & Limo appreciates your business and will work diligently to resolve any concerns you may have. All parties agree that this agreement was made and/or to be performed in the state of New personal jurisdiction in any county within the State of New Jersey and will accept process in accordance with the rules and laws governing such process in the State of New Jersey. All parties agree that venue is proper in any county in New Jersey that Custom Coach and Limo deem to be the most convenient. This contract may be executed in counterparts, each of which shall be deemed to be original but all of which together shall constitute one and the same agreement. The invalidity or unenforceability of any particular provision of this Agreement shall not affect any other provisions, and this Agreement shall be construed in all respects as if such invalid of unenforceable provision was omitted. The parties further agree that any and all disputes or claims arising out of/or in connection with this agreement shall be resolved in the Supreme Court of the State of New Jersey or the Federal District Court of New Jersey.
